Terms and Conditions for Whogoing
1. User Responsibilities:
User should respect each other and provide true info while creating account or publishing rides etc inside the app. User should follow the rules of Govt related to ride and drive specially and providing honest feedback for the community's benefit.
2. Pricing and Payment Systems:
In the app, users pay a one-time fee to setup account and access services.Drivers collect ride payments manually from passengers, while the app handles, account creation, and platform commission fee 10% payments securely using Razorpay Payment Gateway.
3. Guidelines and Behaviour:
- Respect and courtesy are paramount, ensuring polite and cooperative interactions.
- Prioritize safety by adhering to traffic laws and wearing seatbelts.
- Be reliable and punctual, communicate promptly about any delays or changes.
- Maintain honesty, transparency, and respect for property and belongings.
- As Per Indian Govt, If you don't have a commercial license and you don't have a yellow plate reg vehicle, then you can't create more than 2 rides per day. We respect Govt laws.
4. Dispute Resolution:
Disputes between users should be resolved amicably and directly between the parties involved. Users are encouraged to reach out to each other through the in-app contact info share system to discuss and resolve disputes. In the event that a resolution cannot be reached independently:
- Users can contact our customer support team for assistance in resolving disputes.
- We will endeavor to mediate and facilitate communication between users to reach a satisfactory resolution.
- Any unresolved disputes may be subject to further review and action by our team.
5. Cancellation and Commission Policy:
Cancellation by Passenger: Passengers cannot cancel a booked ride once the request is accepted by the driver. Cancellation by Driver: Once a driver accepts a booking request, they cannot cancel the ride. However, they have the option to decline the request without any charge. Refunds are not applicable as there is no cancellation fee for either passengers or drivers. Our platform charges a commission of 10% on the total earnings generated by drivers.
6. Suspension or Termination:
Repeated Violations of Terms of Service, Safety Concerns, Cancellation Abuse, Inappropriate Behavior, Fraudulent Activities, Non-Payment of Fees, Misuse of Platform, Violation of Community Guidelines, Legal Compliance, and Investigation Outcomes.
7. User Data and Information Handled:
Data Collection and Consent, Data Security, Purpose Limitation, Data Minimization, User Rights, Third-Party Services, Transparency and Accountability, Data Breach Response, Cross-Border Data Transfers, and User Education.
8. Account Deletion Request Terms:
Upon submitting an account deletion request, please be aware of the following:
Data Deletion Schedule:
All user data, including name, profile picture,dob,gender,location, published rides, booked rides, shared locations, live tracks, places, interests, and notifications, will be automatically deleted from our system.After 30 days, all retained data associated with the user's account will be permanently deleted from our system.After 30 days of account deletion request user can't get back his or her account.If user loggin back within 30 days and tap on keep my account user can restore the account. Our purpose to keep user data for 30 days is in a case user don't follow the rules or did something wrong we can share user info with the govt if they need from our platform.
Automatic Deletion:
To maintain the integrity of our database and ensure the removal of unwanted information, we have implemented an automatic deletion process for old data.
Notification Deletion:
Notifications older than 2 days will be automatically deleted from our system to prevent clutter and optimize user experience.
Data Retention:
All other data, such as the history of booked rides, published rides, shared locations, and live tracks, will be retained for a maximum period of 30 days.
User Responsibility:
Users are responsible for backing up any important data or information before initiating the account deletion process, as deleted data cannot be recovered once the deletion request is completed.
9. Limitations of Liability for the App Developer:

Disclaimer of Warranties:
The developer may disclaim any warranties, express or implied, regarding the app's functionality, performance, or reliability. Users acknowledge that the app is provided "as is" and use it at their own risk.

Third-Party Services:
The developer may not be liable for any issues or damages resulting from the use of third-party services integrated into the app, such as payment processing, mapping, or communication services. Users are responsible for any risks associated with third-party services.

User Conduct:
Users are responsible for their own conduct while using the app, and the developer is not liable for any damages resulting from user actions, including but not limited to fraudulent activities, harassment, or violation of laws or regulations.

No Guarantee of Service:
The developer may reserve the right to modify, suspend, or terminate the app or its services at any time without prior notice. Users acknowledge that the app may not be available or accessible at all times and that the developer is not liable for any interruptions or disruptions in service.

App Fees:
The developer estimated the account create fee for one time. But if the cost of maintenance for the app goes out of estimation, the developer can charge additional cost or change account create fee, platform commission fee. But the change in fee will not be increased high only the cost-effective price will be taken from users.

Limited Remedies:
In the event of any dispute or dissatisfaction with the app, the user's sole remedy is to discontinue use of the app. The developer's liability is limited to the amount paid, if any, for accessing or using the app.

Force Majeure:
The developer may not be liable for any failure to perform or delay in performance caused by events beyond their reasonable control, such as natural disasters, acts of God, war, terrorism, or government actions.
10. Intellectual Property Rights:

Ownership:
The developer retains ownership of all intellectual property rights associated with the app, including but not limited to code, designs, trademarks, and logos.

License to Users:
Users are granted a limited, non-exclusive license to use the app for its intended purpose. This license does not grant users ownership rights or the right to modify, reproduce, or distribute the app without permission.

Content Ownership:
The developer may own or have licenses for the content displayed within the app, such as text, images, and multimedia. Users are prohibited from using or reproducing this content without authorization.

Protection Measures:
The developer may implement measures to protect the app and its content from unauthorized use, such as encryption, digital rights management, or copyright notices.

User Contributions:
Users may be required to grant the developer a license to use any content or information they contribute to the app, such as reviews, feedback, or user-generated content.

Enforcement:
The developer reserves the right to enforce intellectual property rights and take legal action against any infringement or unauthorized use of the app or its content.
